Disclosure of Brokerage Relationship (Virginia)
When a Virginia licensee deals with someone who is not a client and not represented, the licensee must disclose in writing whom he or she represents. In sales, this is due after a substantive discussion about a specific property, at the earliest practical time and no later than when specific real estate assistance is first provided. For leases it goes in the application or lease, except leases under two months. The statutory form, 'Disclosure of Brokerage Relationship in a Residential Real Estate Transaction,' must be conspicuous.
- Exam tip
- Key timing phrase: 'earliest practical time, no later than when specific real estate assistance is first provided.' A licensee with an ownership interest, including a family member's, must also disclose it in writing.
- Example
- A walk-in buyer from Saturday's open house calls Sunday asking for help setting an offer price; the seller's agent must give the written disclosure before helping.
