Prohibition on Dual Agency (Vermont)

Vermont Real Estate Commission rules prohibit firms and licensees from acting as dual or limited agents for both buyer and seller in the same transaction, with no informed-consent exception. Firms also may not offer services as an intermediary, transaction broker, facilitator, or other non-fiduciary representation, and may not practice both agency models. A firm may represent one party while the other is an unrepresented customer. Before a licensee buys a firm listing, the firm must terminate the agreement, allow outside representation, and disclose the conflict in writing.

Exam tip
'Vermont says no to D-L-F': no Dual, no Limited, no Facilitator. Any answer offering dual agency with both parties' written consent is wrong in Vermont.
Example
A non-designated firm lists a farmhouse and its buyer client wants to offer; the buyer must become a customer or hire an agent at another firm.
