Vermont Real Estate Commission and OPR
Vermont brokerage is governed by 26 V.S.A. chapter 41 and by 3 V.S.A. chapter 5, which covers all professions in the Office of Professional Regulation (OPR) within the Secretary of State. The Real Estate Commission adopts rules, passes on applicant qualifications, and investigates unprofessional conduct using OPR staff. Its seven governor-appointed members are one attorney, two public members, three brokers with four years' experience, and one salesperson. A broker acts for compensation as a continuing course of conduct; leasing alone is excluded from the definition.
- Exam tip
- '1-2-3-1' seats the Commission: 1 attorney, 2 public, 3 brokers, 1 salesperson. Unlike many states, Vermont's broker definition does not reach leasing.
- Example
- An unlicensed person who repeatedly posts neighbors' houses for sale for a percentage is practicing as a broker without a license.
