wetlands

Wetlands are areas where water covers the soil or is present at or near the surface for significant parts of the year, such as marshes, swamps, and bogs. They are protected under federal law, mainly the Clean Water Act, and often by state rules as well. Filling, draining, or building in wetlands typically requires permits, so their presence can sharply limit how a property may be developed and can affect its value.

Exam tip
Expect questions linking wetlands to federal permits (often through the U.S. Army Corps of Engineers) and to disclosure. State wetland rules vary.
Example
A buyer plans to build on a 5-acre parcel but learns 2 acres are protected wetlands, leaving only 3 acres buildable without a permit.
