Dual Agency Consent and Corrected Agency Form (West Virginia)
In West Virginia a licensee may not act for both buyer and seller without the written consent of both, given on the Commission's agency form. When a change in agency status makes the earlier disclosure inaccurate, incomplete, or misleading, such as a customer becoming a client, single agency becoming dual agency, or a team member being added, the licensee must immediately present a corrected form, dated and acknowledged in writing by all parties. A dual agent cannot advocate for one client against the other or reveal either's confidential information.
- Exam tip
- 'Two masters, two signatures. New facts, new form.' Also, a licensee may not negotiate directly with a person exclusively represented by another broker without that broker's authorization.
- Example
- A buyer client wants a colleague's listing at the same firm; before writing the offer, a corrected form disclosing dual agency is dated and signed by the buyer and sellers.
