West Virginia Real Estate Commission

The West Virginia Real Estate Commission regulates brokerage under the Real Estate License Act (W. Va. Code chapter 30, article 40) and rules in Title 174 of the Code of State Rules. It has five members appointed by the Governor with Senate consent: four licensees with ten years in the business and one citizen member, all West Virginia residents for six years, serving four-year terms. It can fine up to $1,000 per day per violation, conduct compliance audits, and suspend or revoke licenses.

Exam tip
'5-4-1-4' plus '10 and 6.' Fines go to the General Revenue Fund, not the Commission. The Commission may examine records only within the specific violation charged.
Example
A buyer's roof misrepresentation complaint lets the Commission examine that transaction file, not every file the salesperson handled for three years.
