Customer as the Default Relationship (Wyoming)

Under W.S. 33-28-302(p), a customer relationship exists in Wyoming unless a single agency or intermediary relationship is established by a written agreement. Agents and intermediaries both require a writing disclosing their statutory duties, and subagency requires the seller's written agreement to offer it. A licensee owes a customer reasonable skill and care but no duty of confidentiality. Participating in a transaction where all parties are customers is a disciplinary ground. Listing agreements belong to the responsible broker.

Exam tip
'No paper, no agency.' In the absence of a written agreement the answer is customer, not intermediary or agent, despite older materials.
Example
An open-house buyer asks a salesperson to write an offer without signing anything; he is a customer and his top price is not confidential.
