Intermediary and the Ban on Dual Agency (Wyoming)
Wyoming prohibits dual agency outright. An intermediary assists one or more parties without acting as an agent or advocate and owes listed duties such as presenting offers, accounting for funds, and disclosing known adverse material facts. Without all parties' informed consent, an intermediary may not reveal that a buyer will pay more, a seller will take less, motivating factors, or willingness to accept other financing. In an in-house deal, an agent may become intermediary to both only with written consent of both, and the fee cannot increase.
- Exam tip
- Dual agency with written consent is never allowed in Wyoming; the consent-based option is intermediary. 'Switch, sign, no raise.' Designating different licensees alone does not create dual agency.
- Example
- A salesperson with both a seller listing and a buyer agency for the same cabin becomes an intermediary after both parties sign written consent.
