Appointed Agency (Iowa)
Under Iowa Code 543B.59, a designated broker may appoint in writing different affiliated licensees to exclusively represent the buyer and the seller in the same transaction, each owing full client duties to their own client. The appointment disclosure names the agent, states the duties, and lets the client consent or decline in writing. Appointing agents does not by itself make the designated broker a dual agent. Disclosed dual agency, by contrast, has one licensee represent both sides with both parties' written consent.
- Exam tip
- Dual means one agent, two clients, two signatures; appointed means two agents, one broker, a written appointment. Verbal consent is never enough.
- Example
- Two agents in one office represent seller and buyer. The broker appoints each to their own client in writing, and the buyer's agent keeps the buyer's top price confidential.
