Specific Assistance and Agency Disclosure (Iowa)
Under Iowa Code 543B.57, a licensee must disclose whom the licensee represents verbally before providing specific assistance, meaning eliciting confidential information about a party's needs, motivation, or finances, or discussing a proposed offer on a specific property. Open house showings, preliminary talk about price range and style, and general factual questions are not specific assistance. A written disclosure, acknowledged by separate signatures, must follow before any offer is made or accepted, and is kept five years.
- Exam tip
- 'Talk at specifics, sign before the offer.' Distractors say 'at first contact' or 'at closing.'
- Example
- At an open house a buyer says they are preapproved for $310,000 and asks what to offer. That is specific assistance, so the agent must immediately disclose that she represents the seller.
