Agency Disclosure Brochure (Idaho)
The Commission-approved brochure that, under Idaho Code 54-2085, a licensee must give a prospective buyer or seller at the first substantial business contact, keeping a signed and dated receipt. It describes nonagency, agency, limited dual agency, and assigned agents, and states that no representation exists without a written agreement. Under the Brokerage Representation Act, agency can only be created by a separate written document, never orally or by implication, and must be settled no later than preparation of the purchase agreement.
- Exam tip
- 'Brochure first, contract before the offer, confirmation in the offer.' Paying a fee or the agent saying 'I'm your agent' does not create agency in Idaho.
- Example
- At a Saturday showing, a caller discusses his budget and plans to offer. The agent must hand him the brochure and get a signed receipt; he stays a customer until a written agreement is signed.
