Limited Dual Agency and Assigned Agents (Idaho)
Idaho does not allow traditional dual agency. Under Idaho Code 54-2088 a brokerage may represent both buyer and seller only as a limited dual agent, with separately signed written consent of every client, which may be given in advance. Without written consent it may not disclose that a buyer would pay more, a seller would accept less, a party's motivation, or willingness to change price or terms. With consent, the brokerage may assign different sales associates to each client, but the designated broker can never be an assigned agent.
- Exam tip
- The designated broker remains a limited dual agent for both clients and cannot 'assign himself' to one side.
- Example
- A firm's agent represents a buyer who says she would go $15,000 higher. The broker assigns another agent to the seller, and the buyer's agent keeps that figure confidential.
