Transaction Broker (Kansas)

Under K.S.A. 58-30,113, a licensee who assists one or more parties with a transaction without being an agent or advocate for any of them. In Kansas, transaction brokerage is the default relationship when no written agency agreement is signed, and it is one of the legal paths for in-house sales where one firm works with both the buyer and the seller. Seller and buyer agency agreements must disclose that the firm might act as a transaction broker.

Exam tip
If no written agency agreement exists, the Kansas licensee is a transaction broker by default, not a seller's subagent and not a dual agent.
Example
A licensee shows a buyer three homes and never signs a buyer agency agreement; when the buyer makes an offer, the licensee is acting as a transaction broker.
