Agency Consent Agreement (KREC Form 401S/401B)
The second Kentucky agency form, Form 401S for sellers and 401B for buyers. It creates a written record of the client's consent to a specific relationship such as single, dual or designated agency. It must be signed before entering a written brokerage agreement or before completing an offer, contract or lease. It discloses any known business, family or personal relationship with another party and whether an unrepresented party is involved. If the relationship changes, it is updated and re-signed.
- Exam tip
- When an in-house buyer turns a single agency into dual or designated agency, new written consent on an updated form is required before the offer is completed.
- Example
- A listing agent's own office produces a buyer, so both seller and buyer sign updated Agency Consent Agreements choosing designated agency before the offer is written.
