agency

Appointed Agency (Maine)

A Maine arrangement in which an agency, through its designated broker, appoints specific affiliated licensees in writing to represent a client to the exclusion of all other licensees in the agency. An appointment does not, by itself, make the agency or designated broker a dual agent, and knowledge is not imputed among the appointed licensees. If a single licensee personally represents both seller and buyer in the same transaction, that licensee is a dual agent and must follow the disclosed dual agency rules.

Exam tip
Appointed agency avoids firm-wide dual agency for in-house sales, unless one individual licensee represents both sides.
Example
A firm's listing agent is appointed for the seller and a colleague is appointed for an in-house buyer; neither the agency nor the designated broker becomes a dual agent.
