Agency Relationships in Real Estate Transactions (Disclosure Form)
Minnesota's statutory agency disclosure form (Minn. Stat. §82.67, subd. 1), which a licensee must provide at the first substantive contact in residential (one-to-four-family) transactions. The consumer signs to acknowledge receipt. It states it is a disclosure form only, not a contract; explains that representation requires a written listing or buyer's broker agreement; describes four relationships (seller's broker, buyer's broker, dual agency and facilitator); notes dual agency requires written consent; and lists the fiduciary duties.
- Exam tip
- Substantive contact, such as discussing budget or motivation, triggers the form; small talk does not. Signing it does not hire the licensee.
- Example
- At an open house a couple begins describing their budget and need to sell first; the salesperson hands them the agency form before continuing.
