Agency Disclosure Form A: Working With a Real Estate Broker

Mississippi's required written agency disclosure (MREC Rule 4.3). Disclosure to one's own client must be made in writing before the listing or buyer agency agreement is signed. A broker who is not a party's agent must disclose in writing that the broker represents someone else at the first substantive meeting with that party. The form states in bold that it is not a legally binding contract; licensees may duplicate but not alter it. If the relationship changes, all parties acknowledge new forms.

Exam tip
Chatting about schools or asking price is not a substantive meeting; eliciting financial qualifications or motivation is.
Example
A couple at an open house says they are pre-approved for $400,000 and must move by June; the listing agent gives Form A, disclosing that she represents the seller, before going further.
