Agency Disclosure at First Substantial Contact (Nebraska)

Under Neb. Rev. Stat. 76-2421, a licensee must give the Commission's agency disclosure at the earliest practicable opportunity during or after first substantial contact with a seller, landlord, buyer or tenant who does not already have a written agreement with a designated broker. Signing the disclosure does not create an agency contract. The agency disclosure rules also apply when someone publicly markets an equitable interest in a purchase contract (wholesaling).

Exam tip
The disclosure informs; it is not an agreement. Representation of a 1-4 unit residential buyer now also requires a separate written buyer agreement.
Example
A buyer at an open house begins discussing his budget and timeline; the licensee provides the agency disclosure at that first substantial contact.
