Consent to Act (Form 524) and Assigned Agency

When one Nevada licensee represents more than one party in a transaction, NRS 645.252(1)(d) requires written consent from each party before acting, on the Division's Form 524, 'Consent to Act'. It confirms the licensee owes both parties the same duties. By contrast, in assigned agency the broker assigns two different licensees in one brokerage, one per party; no Consent to Act is needed, but each licensee may disclose the client's confidential information only to the broker.

Exam tip
One licensee for both sides needs a Consent to Act from each party; two licensees in one firm (assigned agency) do not.
Example
A listing agent's own buyer client wants to make an offer on her listing; she must get signed Consent to Act forms from both parties before representing both.
