Designated Sales Agent (New York)

In New York, when a broker is already a consenting dual agent for both buyer and seller in an in-house transaction, the broker may appoint designated sales agents: one salesperson or associate broker to work with the buyer and another to work with the seller. Each designated agent advocates for the assigned client within the limits of the dual agency. The roles are explained on the RPL §443 agency disclosure form.

Exam tip
Designated sales agents exist only inside a consented dual agency; the broker remains a dual agent.
Example
A firm lists a home and its other salesperson has a buyer client who wants to see it; after both consent to dual agency, the broker designates one agent for each side.
