Split Agency (Ohio In-Company Transaction)
In Ohio, split agency is an in-company transaction where one licensee represents the seller and a different licensee in the same brokerage represents the buyer. Each licensee is the exclusive agent of his or her own client and is not a dual agent, but the brokerage and its supervising management-level licensees are treated as dual agents. It is allowed only if the brokerage has procedures preventing licensees who represent one client from accessing the other client's confidential information.
- Exam tip
- The common trap: in split agency the brokerage is the dual agent, not the two individual agents. 'Two agents, one roof: the roof is dual.'
- Example
- At one firm, Ana lists a home and Ben represents a buyer for it; Ana and Ben each serve only their own client, while the principal broker becomes a dual agent and must keep the seller's bottom line away from Ben's side.
