Agency Disclosure Statement (Ohio)
The Ohio Agency Disclosure Statement is a transaction-specific form (ORC 4735.57) showing which party each licensee represents in a particular deal and whether there is dual agency or separate in-company representation. A purchaser's agent must have the buyer sign it no later than when the offer is prepared; the seller's agent must have the seller sign it before presenting a written offer. Dual agency requires written informed consent from both parties on this form. Short rentals of 18 months or less, referrals, and cemetery lots are exempt.
- Exam tip
- Remember 'Guide at the greeting, Statement at the offer.' Oral consent or seller-only consent to dual agency is always wrong; it must be written consent from both.
- Example
- A buyer's agent prepares an offer on Saturday and has the buyer sign and date the Agency Disclosure Statement at that time, then sends the signed copy to the listing agent.
