Disclosed Limited Agency (Oregon)
Disclosed limited agency is Oregon's term for dual agency: one real estate business represents both buyer and seller, or two or more buyers for the same property. It requires full disclosure and a signed written agreement. Without written permission, the licensee may not tell the buyer the seller would take less or tell the seller the buyer would pay more. When two brokers at the same firm represent opposite sides, only the principal broker becomes the disclosed limited agent; each broker keeps representing only his or her own client.
- Exam tip
- In a same-firm, two-broker deal, the disclosed limited agent is the principal broker, not the two brokers. After HB 4058, a disclosed limited agent needs three signed documents: listing, buyer agreement, and DLA agreement.
- Example
- At one firm, broker Luis lists a ranch and broker Faye brings a buyer; principal broker Gwen becomes the disclosed limited agent and cannot share the seller's willingness to take $40,000 less.
