Initial Agency Disclosure Pamphlet (Oregon)
Under ORS 696.820, an Oregon agent must give each prospective party a copy of the initial agency disclosure pamphlet at first contact, whether in person, by phone, online, or by email, once the agent has enough contact information to deliver it. The pamphlet explains seller's agency, buyer's agency, and disclosed limited agency, defines confidential information, and states that no one can make a licensee their agent without the licensee's consent. It is informational only and requires no consumer signature.
- Exam tip
- 'Pamphlet first, signature last.' The pamphlet is due at first contact and has no signature requirement; the signed form is the Final Agency Acknowledgement that comes with the offer.
- Example
- A buyer emails a broker through her website about a listed bungalow; she replies with a PDF link to the pamphlet without needing his signature.
