Final Agency Acknowledgement (Oregon)
The Final Agency Acknowledgement (ORS 696.845) is the signed written confirmation required in every Oregon transaction stating that both parties received the agency pamphlet and identifying each party's agent and type of agency. The buyer signs it when signing the sale agreement, before it goes to the seller; the seller signs when the offer is first presented, even if rejecting or countering. On a preprinted sale agreement it sits at the top of the first page with separate signatures.
- Exam tip
- The seller's signature on the acknowledgement is not acceptance of the offer. Do not confuse it with the pamphlet, which is given at first contact and needs no signature.
- Example
- A seller signs the acknowledgement at the top of page one when her broker presents an offer, then sends a counteroffer.
