Act 250 (Vermont)
Act 250 (10 V.S.A. chapter 151) is Vermont's 1970 statewide land use law requiring a land use permit from a District Commission, reviewed against ten criteria, for projects within its jurisdiction, in addition to local permits. Triggers include commercial or industrial construction on more than 10 acres (1 acre in towns without full bylaws), 10 or more housing units within five miles in five years, subdividing into 10 or more lots (6 without bylaws) in five years, and building above 2,500 feet. Permit conditions run with the land.
- Exam tip
- '10 and 1, 10 and 6, 5 and 5, 2,500 high.' Lots created by the same person within five miles and five years are counted together.
- Example
- A developer plans 8 lots this year but created 3 lots four miles away two years ago; 11 lots within five years and five miles triggers Act 250.
