Real Estate Brokerage in Washington Pamphlet
'Real Estate Brokerage in Washington' is the required pamphlet (RCW 18.86.120), replacing the older 'The Law of Real Estate Agency.' A broker must provide it before a party signs a services agreement, or for an unrepresented party before signing an offer or as soon as practical. Providing it is one of the duties owed to all parties, along with reasonable skill and care, honesty, presenting all written offers, disclosing known material facts, accounting for funds, and disclosing in writing whom the broker represents in the purchase agreement's Agency Disclosure paragraph.
- Exam tip
- 'The pamphlet comes before the signature.' A death, crime, or political or religious activity on the property is not a material fact unless it affects physical condition or title.
- Example
- A listing broker knows of an unpermitted basement apartment and must disclose it to an unrepresented buyer, but need not raise a prior owner's natural death.
