Services Agreement (Washington)
Under RCW 18.86 effective January 1, 2024, a written services agreement between a firm and a principal is required on both sides of a transaction, entered before or as soon as reasonably practical after the broker begins providing services. A broker serving a buyer is the buyer's agent by default. Buyer agreements must state the term (60 days if none stated), exclusive or nonexclusive status, consent to limited dual agency, compensation, and whether the broker will show properties where no one offers to pay the buyer's firm.
- Exam tip
- 'Default buyer, default sixty, always in writing.' Answers saying a buyer relationship can be oral or implied are out of date. Commercial buyer's agents are excepted.
- Example
- A broker shows a couple three houses Saturday; his firm must sign a services agreement with them promptly, and a blank term runs 60 days.
