Seller Disclosure Statement, Form 17 (Washington)
Washington sellers of improved residential property must give buyers a seller disclosure statement under RCW 64.06, known as Form 17, covering title, water, sewer, structure, systems, HOA, environmental, and manufactured home items based on the seller's actual knowledge. Unless the buyer waives it, the seller delivers it within five business days after mutual acceptance, and the buyer then has three business days to approve it or rescind in writing at the buyer's sole discretion, receiving deposits back. If no rescission is delivered, the statement is deemed approved.
- Exam tip
- 'Five to give, three to leave.' The seller completes the form, not the broker; the broker still must disclose material facts the broker actually knows.
- Example
- Mutual acceptance is Monday, June 1 and Form 17 arrives June 4; the buyer has through June 9 to rescind and does so after learning of a failed septic inspection.
