Limited Dual Agent (Washington)
A Washington limited dual agent represents both buyer and seller in the same transaction, which requires the written consent of both, given in the services agreements. The limited dual agent must take no action adverse to either party, disclose conflicts, keep both parties' confidential information, and may not advocate terms favoring one principal over the other. When two different brokers in the same firm represent opposite sides, each keeps only his or her own client, while the designated broker and any supervising managing broker become limited dual agents.
- Exam tip
- In-house rule: the brokers each keep one client; the supervisors become dual agents. Consent must come from both parties, in writing.
- Example
- Owen lists a condo and colleague Beth represents a buyer for it; their designated broker becomes a limited dual agent and needs both clients' written consent.
