Disclosure to Customers and Disclosure to Clients (Wisconsin)

Wisconsin's Section 452.135 prescribes two statutory disclosure statements. A firm may not negotiate on behalf of a non-client without first giving the Disclosure to Customers, which lists duties owed to all parties such as honesty, reasonable skill and care, written disclosure of material adverse facts, confidentiality, and safeguarding trust funds. The Disclosure to Clients must be given no later than entering the agency agreement and explains client duties, multiple representation choices, and subagency. Negotiating includes completing approved forms at a party's request.

Exam tip
'Show without it, write with it.' Showing a property does not trigger the customer disclosure, but writing an offer does.
Example
An unrepresented buyer tours a listing and asks the listing agent to write an offer; the agent must give the Disclosure to Customers before completing the WB-11.
