Multiple Representation and Designated Agency (Wisconsin)
A Wisconsin multiple representation relationship exists when one firm has two or more clients who are parties in the same transaction, and it requires written consent of all those clients. Clients may consent to designated agency, where different licensees negotiate for each client and may give information, opinions, and advice even to one client's advantage; consent to multiple representation without designated agency, where no one may favor either client; or reject multiple representation. Consent to designated agency may be withdrawn in writing at any time.
- Exam tip
- 'Two clients, one firm, everybody signs.' Designated agency is not automatic; it requires written consent of all clients.
- Example
- A firm's seller client and buyer client both consented to designated agency, so Ana may advise the buyer to offer less while Ben advises the seller to counter firmly.
