Real Estate Brokerage Relationships Brochure
The Commission-approved brochure (K.S.A. 58-30,110; K.A.R. 86-3-26) that each Kansas licensee must give prospective buyers and sellers at the first practical opportunity. It must show the licensee's name, the supervising or branch broker's name if applicable, and the firm name registered with KREC. Every sales contract must acknowledge receipt of the brochure. Exemptions include licensees acting only as principals, commercial property, residential property over four units, public auctions and purely ministerial acts.
- Exam tip
- Timing is 'first practical opportunity', and the sales contract must acknowledge the brochure was received; commercial deals are exempt.
- Example
- At a first meeting to discuss selling a duplex, the licensee hands the owners the brochure before discussing pricing strategy.
