Residential Property Condition Disclaimer Statement (Oklahoma)
The Residential Property Condition Disclaimer Statement is the OREC form an Oklahoma seller may use instead of the disclosure statement, but only when the seller has never occupied the property, makes no disclosures about it, and has no actual knowledge of any defect. Investors who never lived in a home and know of no problems are the typical users. Once the seller learns of a defect, the disclaimer is no longer appropriate and a disclosure statement must be given.
- Exam tip
- Both conditions must be met: never occupied AND no actual knowledge of defects. A non-occupant seller who knows of a leak cannot use the disclaimer.
- Example
- An investor who bought a house at a tax sale and never lived there may use the disclaimer, until her agent tells her about fresh water stains on the basement ceiling.
